Divorce and Marriage:

Marriages in India are solemnised according to traditions and rituals. These customs are written down in the form of personal laws. Personal law in Hinduism, for example, is separated into Mitakshara and Dayabhaga branches. However, because marriage and divorce are intertwined concerns, they are governed by personal rules, which vary depending on their religion.

  • 1.    Hindu Marriage Act 1955.
  • 2.    Muslim marriage is a contract under Muslim law.
  • 3.    Indian Christian Marriage Act 1872 and the Christian Divorce Act 1869.
  • 4.    Parsi Marriage and Divorce Act 1936.

Apart from that, under Article 44 of the Indian Constitution, an attempt is made to enact a Uniform Civil Code in the form of the Special Marriage Act 1954, which applies to people of all faiths. However, whether the marriage is governed by the Special Marriage Act or by personal law is up to the discretion of the parties. Marriage and divorce are both controlled by the same set of rules. Our family lawyers pay close attention to the aforementioned points since it is critical for Indian family lawyers to have a thorough understanding of the topics stated.

The Welfare of Children.

The Guardian and Wards Act of 1890 is a general regulation in India that applies uniformly to all religions. Different marriage-related personal laws, on the other hand, include measures for the welfare of children born in the marriage.
